Michael Jordan Testifies He ‘Wasn’t Afraid’ of Nascar in Antitrust Trial
Michael Jeffrey Jordan, as he cordially introduced himself in a Charlotte court on Friday, stated that his competitive side and novelty within the sport motivated his effort with 23XI Racing to confront Nascar over perceived violations of competition laws.
Financial Stakes and a Will to Win
The owner disclosed financial and corporate details of his 23XI team, saying he invested $40 million of his personal wealth into the Cup Series operation launched with business partner Curtis Polk and longtime driver Denny Hamlin.
“Someone had to step forward,” Jordan stated in the Charlotte courtroom. “As a newcomer, I wasn’t afraid. I felt I could challenge Nascar as a whole. I felt as far as the sport required examination from a different view.”
Central Issue: Franchise System and Renewal Demands
The heart of the case involves the end of a 2016 agreement where Nascar granted each team a “charter”. This system mirrors other major leagues with separately owned franchises, like the Charlotte Hornets or the NFL’s Panthers. This deal was due to end in 2024 when Nascar demanded charter membership renewals.
Jordan was on the witness stand for about sixty minutes and left the court to a media frenzy, with onlookers and reporters vying for a glimpse or a picture of the sports legend.
Leading the Legal Charge
Jordan’s 23XI is leading the full-court press along with Front Row Motorsports for Nascar to change a business model Jordan said is breaking the law to keep two hands on the wheel.
At issue for Jordan and a fellow team representative, who preceded Jordan, are details from September 2024. She recounted a frantic and emotional six hours where the sanctioning body informed teams they had to sign a charter agreement extension. This agreement consists of 112 pages outlining pay for chartered teams and a guaranteed entry in every race.
Choosing Litigation
Jordan said that 23XI and Front Row Motorsports concluded their only feasible option was to decline to sign that extensive document and take the issue to court. All other teams agreed to the terms.
Jordan and co-owner Denny Hamlin reached out to Nascar about possible changes or extension options. Nascar refused to engage, according to his testimony.
The Bottom Line: Victory
Ultimately, the resistance against what he saw as a financially unsustainable model was mostly about the familiar goal for Jordan: Success.
“Hamlin persuaded me adding a third car boosted our odds of winning,” he said, sharing that he bought a third charter late in 2024 for $28m amid the legal dispute. “So I dove in.”

Heather Gibbs detailed her request for permanent charters, which she said a formal letter to Nascar. She testified the pressure of the signature deadline was problematic.
She said, Joe Gibbs first attempted to call and talk Nascar out of demanding signatures, but CEO Jim France refused the appeal.
“Please don’t force this on us,” Heather Gibbs said was the message to Nascar’s leadership. The response was, “If I wake up and I have 20 charters, that’s what I have. If there are 30, I have 30.”
